Terms of Service

Professional terms for GenTenX financial analysis reports,
customer uploads, scheduled report delivery, and review-call services.

Effective Date: May 1, 2026

Terms Summary: These Terms of Service govern use of the GenTenX website and the purchase, upload, scheduling, delivery, and review process for GenTenX financial analysis reports. By using the website, purchasing a report, uploading financial information, or scheduling a review call, customers agree to these Terms and the policies referenced here, including the Refund & Cancellation Policy and Privacy Policy.

1. Overview of GenTenX Services

GenTenX, LLC (“GenTenX”) provides custom financial analysis reports prepared using financial information submitted by the customer. GenTenX reports are professional analysis products and are not instant digital downloads, automated template reports, or generic financial summaries. Each report is prepared based on the information provided by the customer and the scope of the report package purchased.

Each GenTenX report includes a scheduled report delivery and review call. Standard report tiers include a 30-minute review call, and the premium report tier includes a 1-hour review call. The review call is intended to deliver and explain the completed report. It is not an intake call, and GenTenX’s delivery timeline begins only after the customer has uploaded the required financial information.

2. Informational and Analytical Purpose Only

GenTenX reports are provided for informational, educational, analytical, and business-planning purposes only. GenTenX does not provide investment, tax, legal, accounting, lending, brokerage, insurance, or fiduciary advice through its reports, website, review calls, or related communications unless expressly stated in a separate written agreement signed by GenTenX.

A GenTenX report should not be treated as a guarantee, instruction, recommendation, or promise to make or avoid any specific financial, investment, business, lending, tax, legal, or personal decision. Customers are encouraged to consult qualified professionals, including financial advisors, tax professionals, accountants, attorneys, lenders, or other appropriate advisors, before making decisions based on a GenTenX report.

3. No Guarantee of Financial or Business Outcomes

GenTenX strives to provide thoughtful, professional, and useful financial analysis based on the information submitted by the customer. However, GenTenX does not guarantee any specific financial result, business outcome, investment performance, financing outcome, tax result, operational improvement, cost savings, profitability change, or personal financial outcome.

Financial and business outcomes depend on many factors outside GenTenX’s control, including market conditions, customer decisions, business performance, expenses, financing terms, tax circumstances, third-party actions, personal circumstances, and changes in law or economic conditions. The customer remains solely responsible for all actions, decisions, and changes made before or after receiving a GenTenX report.

Disagreement with a report’s findings, assumptions, conclusions, observations, or analytical perspective does not mean the report is defective and does not create a right to a refund.

4. Customer Responsibilities

Customers are responsible for providing complete, accurate, current, readable, and authorized financial information. GenTenX’s analysis depends on the information submitted by the customer, and incomplete, inaccurate, outdated, unreadable, or misleading information may affect the accuracy, relevance, or usefulness of the completed report.

Customers should review all information before uploading it and should promptly notify GenTenX if they discover an error or omission in the information they provided. Customers are also responsible for ensuring they have the right and authority to upload, share, and request analysis of any financial information submitted to GenTenX.

If a customer does not provide required financial information or respond to necessary requests within 10 calendar days, the order may be closed in accordance with the GenTenX Refund & Cancellation Policy.

5. Order Process, Delivery, and Review Call

The standard GenTenX order process is as follows: the customer purchases a report, uploads the required financial information, schedules an available report review call, GenTenX prepares the analysis, and the completed report is delivered and reviewed during the scheduled call.

The delivery date for a GenTenX report is the customer’s scheduled report review call date. The report delivery timeline begins only after the customer has uploaded the required financial information. If required information is missing, delayed, incomplete, unreadable, or requires clarification, the delivery timeline may be affected.

Customers schedule review calls by selecting from available calendar slots. If GenTenX has no available slots because of vacation, planned time away, limited calendar availability, or other scheduling constraints, unavailable dates and times will not appear as selectable options. Customers are responsible for selecting a review call time they can attend and for monitoring any scheduling confirmations or reminders.

6. Payment Terms

Payment is due at checkout unless otherwise stated in writing. An order is not considered active until payment has been successfully received. Prices, packages, included services, and available report tiers are displayed at checkout and may change from time to time on a prospective basis.

Customers are responsible for providing accurate billing information and for satisfying any applicable taxes, fees, or payment-processing requirements. GenTenX may use third-party payment processors, and payment processing may be subject to the terms, conditions, and privacy practices of those third-party providers.

Cancellations, refunds, missed deadlines, customer inactivity, non-refundable payments, and related payment issues are governed by the separate GenTenX Refund & Cancellation Policy.

7. Cancellations, Refunds, and Rescheduling

GenTenX’s cancellation, refund, inactivity, missed-call, and rescheduling rules are set forth in the GenTenX Refund & Cancellation Policy. Customers should review that policy before purchasing a report.

As a general summary, customers may cancel within 24 hours of purchase, and payment is final and non-refundable after 24 hours except for the limited exceptions stated in the Refund & Cancellation Policy. No refund is provided merely because a customer disagrees with the report’s analysis, assumptions, findings, conclusions, or recommendations. Rescheduling is subject to available calendar slots and the requirements of the Refund & Cancellation Policy.

If there is any inconsistency between this section and the Refund & Cancellation Policy, the Refund & Cancellation Policy controls for refund, cancellation, inactivity, missed-call, and rescheduling matters.

8. Report Use, Ownership, and Intellectual Property

Customers may use their completed GenTenX report for personal review, internal business planning, financial understanding, and discussions with their own advisors, lenders, accountants, attorneys, business partners, or internal team members. Customers retain rights to the financial information they provide to GenTenX.

GenTenX retains ownership of its website content, branding, report formats, templates, frameworks, analytical methods, written explanations, design elements, service processes, and other intellectual property. The purchase of a report does not transfer ownership of GenTenX’s underlying intellectual property to the customer.

Customers may not resell, republish, publicly post, commercially redistribute, copy for competitive purposes, reverse engineer, or create derivative commercial products from GenTenX reports, templates, frameworks, website content, or other materials without GenTenX’s prior written permission.

9. Confidentiality and Customer Information

GenTenX treats customer financial information with care and uses submitted information for purposes related to preparing, delivering, supporting, and maintaining the purchased report and related services. Customers should not upload information they are not authorized to share.

The GenTenX Privacy Policy explains how GenTenX collects, uses, stores, processes, shares, and protects personal and financial information. GenTenX may retain records as reasonably necessary for business, legal, compliance, tax, security, customer-service, and recordkeeping purposes, subject to the Privacy Policy.

10. Errors, Omissions, and Corrections

GenTenX strives to provide accurate and professional work based on the information provided by the customer. If a customer believes a completed report contains a clear error, omission, formatting issue, or calculation issue, the customer should notify GenTenX promptly and provide enough detail for GenTenX to review the concern.

If GenTenX confirms that a report contains an error or omission, GenTenX may correct or revise the report in a commercially reasonable manner. Correction or revision is the primary remedy for confirmed errors or omissions and does not automatically create a right to a refund.

Differences in professional judgment, interpretation, assumptions, conclusions, or analytical perspective are not necessarily errors or omissions.

11. Website Use and Prohibited Conduct

Customers may use the GenTenX website only for lawful purposes and in a manner that does not interfere with the website, checkout process, scheduling process, upload system, delivery process, or other customers’ ability to use the website.

Customers may not attempt to gain unauthorized access to the website or related systems, disrupt or damage the website, upload malicious files, misuse the upload process, scrape or copy website content for unauthorized purposes, impersonate another person or entity, provide fraudulent billing or account information, or upload information they do not have the right to provide.

This section is intended to help maintain a secure, reliable, and professional experience for all GenTenX customers.

12. Third-Party Services and Platforms

GenTenX may use third-party services or platforms for payment processing, scheduling, file upload, website hosting, communications, analytics, security, customer support, or other operational purposes. These third-party services may have their own terms, conditions, privacy practices, availability limitations, and security procedures.

GenTenX is not responsible for outages, delays, errors, data-processing issues, policy changes, or other actions or omissions of third-party systems outside GenTenX’s reasonable control.

13. Availability, Delays, and Force Majeure

GenTenX will make reasonable efforts to provide services according to the applicable order details and scheduled review call. However, delays may occur because of events outside GenTenX’s reasonable control, including technology failures, payment-platform issues, file-upload issues, internet outages, illness, emergencies, severe weather, legal restrictions, third-party service disruptions, or other circumstances that could not reasonably be prevented.

Scheduling availability is based on open calendar slots. If GenTenX is unavailable because of vacation, planned time away, limited availability, or other scheduling constraints, those unavailable dates and times will not appear as selectable options.

14. Communications and Electronic Delivery

Customers consent to receive communications electronically from GenTenX, including order confirmations, upload instructions, scheduling notices, review call reminders, report-related messages, policy notices, and delivery communications. Customers are responsible for providing a valid email address and monitoring that email address for GenTenX communications.

Reports may be delivered electronically and reviewed during the scheduled report review call. Electronic communications satisfy any requirement that communications be provided in writing, to the extent permitted by law.

15. Limitation of Liability

To the maximum extent permitted by law, GenTenX will not be liable for indirect, incidental, consequential, special, punitive, exemplary, or lost-profit damages arising out of or related to the website, reports, review calls, customer decisions, third-party actions, or these Terms.

GenTenX is not responsible for business losses, investment losses, tax consequences, lending decisions, financing outcomes, opportunity costs, lost revenue, lost profits, market changes, operational decisions, personal financial decisions, or other results arising from the customer’s use of a report or reliance on information discussed by GenTenX.

To the maximum extent permitted by law, GenTenX’s total liability for any claim arising out of or related to a specific report or service will not exceed the amount the customer paid to GenTenX for the specific report giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to every customer.

16. Indemnification

The customer agrees to defend, indemnify, and hold harmless GenTenX and its owners, officers, employees, contractors, agents, representatives, and service providers from and against claims, damages, losses, liabilities, costs, and expenses arising out of or related to the customer’s misuse of the website or report, inaccurate or unauthorized information provided by the customer, violation of these Terms, unlawful conduct, infringement of third-party rights, or decisions made based on a GenTenX report.

17. Changes to Services, Pricing, and Terms

GenTenX may update its services, report packages, pricing, website content, policies, and these Terms from time to time. Changes generally apply prospectively and do not reduce the services already purchased by a customer unless the customer agrees, the change is legally required, or the change is necessary to address an issue outside GenTenX’s reasonable control.

The effective date at the top of these Terms identifies the current version. Continued use of the GenTenX website or services after updated Terms are posted constitutes acceptance of the updated Terms.

18. Governing Law, Dispute Resolution, Arbitration, and Jury-Trial Waiver

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent the Federal Arbitration Act applies to any arbitration proceeding.

Before initiating arbitration or any other formal proceeding, the customer and GenTenX agree to first attempt in good faith to resolve any dispute, claim, or controversy arising out of or relating to the website, a report purchase, a GenTenX report, a review call, these Terms, or any related policy. This good-faith resolution process is intended to give both sides a reasonable opportunity to address concerns directly before a formal dispute is filed.

If a dispute cannot be resolved informally, the dispute will be resolved by binding arbitration administered by the American Arbitration Association under its applicable arbitration rules, unless the parties agree in writing to another arbitration provider or procedure. The arbitration will be conducted by a single neutral arbitrator. The arbitration may be conducted in person, virtually, or by secure remote electronic means, as determined by the arbitrator or agreed by the parties.

The seat or legal place of arbitration will be Gregg County, Texas, unless applicable law requires otherwise or the parties agree in writing to another location. The arbitrator’s award will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Notwithstanding the arbitration requirement, either party may seek temporary, preliminary, or injunctive relief in a court of competent jurisdiction when necessary to protect confidential information, intellectual property, website security, customer information, or other rights that could be harmed before arbitration is completed.

To the extent permitted by law, the prevailing party in arbitration may recover reasonable attorneys’ fees and costs if awarded by the arbitrator or authorized by applicable law.

To the maximum extent permitted by law, the customer and GenTenX knowingly waive any right to trial by jury for any dispute, claim, or controversy arising out of or relating to the website, a report purchase, a GenTenX report, a review call, these Terms, or any related policy.

19. Severability, Entire Agreement, and No Waiver

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

These Terms, together with the policies referenced in these Terms and the order details presented at checkout, form the agreement between the customer and GenTenX for the purchased services. GenTenX’s failure to enforce any provision of these Terms does not waive GenTenX’s right to enforce that provision later.
